Privacy Policy

Effective date: 13 April 2026

Coastal Homes Marbella (“Coastal Homes”, “we”, “us”, or “our”) respects your privacy. This Privacy Policy explains what personal information we collect when you visit chmarbella.com, submit an enquiry, or otherwise contact us, and how we use, share, and protect that information.

By using our website or submitting any form, you confirm that you have read and understood this Policy.

1. Who We Are

Coastal Homes Marbella is an independent real estate agency based in Marbella, Costa del Sol, Spain. We help clients buy, sell, and invest in residential property across the Costa del Sol. For any questions about this Policy or your personal data, you can reach us at Corinna@chmarbella.com or by post to: Marbella, Costa del Sol, Spain.

2. Information We Collect

We collect information in the following ways:

Information you give us

  • Contact details you enter into any enquiry form on our website (full name, email address, phone number)
  • Information you provide about your property search (intended budget, areas of interest, property type, other preferences)
  • Any free-text message or question you submit with a form
  • Details submitted through a Google Ads Lead Form (name, email, phone number, as authorised by you when you submit the form)
  • Information exchanged when you call, email, WhatsApp, or otherwise correspond with us

Information collected automatically

  • Technical data about your device and visit (IP address, browser, operating system, referring URL, pages viewed, approximate location)
  • Analytics and advertising identifiers (including Google Click Identifiers / GCLIDs, and UTM parameters appended to ad URLs) used to attribute leads to specific ads
  • Cookies and similar technologies — see Section 7 below

3. How We Use Your Information

We use your information to:

  • Respond to your enquiries and arrange viewings
  • Send you a shortlist of properties that match your preferences
  • Provide ongoing updates about properties and market information you have asked to receive
  • Operate and improve our website, analyse how visitors use it, and measure the effectiveness of our advertising campaigns
  • Comply with legal and regulatory obligations
  • Protect against fraud, abuse, and unauthorised access

4. Legal Basis for Processing

Under the EU General Data Protection Regulation (GDPR), we rely on the following legal bases to process your personal data:

  • Consent — where you actively submit a form, opt in to receive property updates, or accept analytics cookies.
  • Legitimate interests — to operate our business, respond to enquiries, improve our services, and measure the performance of our advertising.
  • Legal obligation — where we are required by law to retain or disclose information.

5. Who We Share Your Information With

We do not sell your personal information. We share it only with the following categories of recipients, and only to the extent necessary:

  • GoHighLevel — our customer relationship management (CRM) platform. Enquiry details are stored here so our team can follow up with you.
  • Google — we use Google Analytics to measure website usage, and Google Ads (including Lead Form Assets) to attribute enquiries to specific campaigns. Data shared with Google is subject to their own privacy policy.
  • Resales Online — the property database provider we use to search for listings relevant to your enquiry.
  • Professional advisors — lawyers, notaries, or conveyancers, only with your consent when you instruct us to support a specific transaction.
  • Authorities — where we are legally required to disclose information, or where disclosure is necessary to protect rights, safety, or property.

6. International Transfers

Some of the service providers we rely on (including Google and GoHighLevel) may process your personal data outside the European Economic Area, including in the United States. Where this happens, we rely on appropriate safeguards required by the GDPR — typically the European Commission's Standard Contractual Clauses — to ensure your data continues to be protected.

7. Cookies and Similar Technologies

Our website uses cookies and similar tracking technologies. Cookies are small files stored on your device that help us provide a better experience and understand how visitors use our site. The main categories we use:

  • Strictly necessary — required for the site to function (security, form handling).
  • Analytics — Google Analytics to measure traffic and usage patterns.
  • Advertising — Google Ads conversion tracking to measure which ads generate enquiries.
  • Spam protection — Google reCAPTCHA to detect and block automated form submissions.

You can control cookies through your browser settings. Disabling analytics or advertising cookies will not prevent the site from working but may affect our ability to measure how you found us.

8. Data Retention

We keep enquiry and contact information for as long as you remain an active prospect or client, and for a reasonable period thereafter to handle any follow-up questions, legal obligations, or disputes. If you ask us to delete your information, we will do so unless we are legally required to keep it.

9. Your Rights

Under the GDPR, you have the right to:

  • Access the personal data we hold about you
  • Request correction of inaccurate or incomplete information
  • Request deletion of your personal data (“right to be forgotten”)
  • Object to or restrict certain kinds of processing (including direct marketing)
  • Request a portable copy of your data in a machine-readable format
  • Withdraw any consent you have previously given, at any time
  • Lodge a complaint with a data protection authority — in Spain, the Agencia Española de Protección de Datos (AEPD)

To exercise any of these rights, please email us at Corinna@chmarbella.com.

10. Security

We use appropriate technical and organisational measures to protect your information against unauthorised access, loss, or misuse. All form submissions are transmitted over encrypted (HTTPS) connections, and data stored in our CRM is protected by access controls and authentication. No system can be guaranteed to be completely secure, but we work continuously to maintain safeguards.

11. Children’s Privacy

Our website and services are directed to adults interested in purchasing or investing in residential property. We do not knowingly collect personal information from children under 16. If you believe a child has provided us with personal information, please contact us and we will delete it.

12. Changes to This Policy

We may update this Policy from time to time to reflect changes in our practices or for legal reasons. When we do, we will update the “Effective date” at the top of this page. We encourage you to review this Policy periodically.

13. Contact Us

If you have any questions about this Policy or how we handle your information, please contact us at Corinna@chmarbella.com.
